These Terms of Service (“Terms”) govern your use of our services, including real estate photography, videography, floor plans, virtual tours, and digital content delivered through our website or client portal. By booking a service or accessing content, you agree to the following terms.
Miami Luxe Images offers real estate media services, including but not limited to:
All services are performed as described at the time of booking.
Services may be booked through our online portal or directly with our team.
Payments are processed securely via Stripe and may be required in advance or at delivery, depending on prior arrangements. Failure to submit payment may result in delayed delivery or withholding of content.
Appointments must be canceled or rescheduled at least 24 hours in advance to avoid cancellation fees.
Late cancellations may be subject to a fee. Weather-related reschedules are handled on a case-by-case basis.
All media produced, including photos, videos, virtual add-ons, and floor plans, remains the sole property of Miami Luxe Images, unless otherwise agreed upon in writing.
The client is granted a limited, non-transferable license to use the produced media solely for marketing a single property listing while it is actively represented by the client.
This license is valid only during the active listing period.
If the listing agent or brokerage changes, the license automatically terminates and continued use requires a new license.
The client may use the media for marketing materials and campaigns related to the sale of the property, as well as for the client’s own promotional purposes. The client’s parent company may also use the media solely for marketing the specific photographed property.
Miami Luxe Images retains full ownership of all media.
Licensing is granted only to the client and the client’s parent company.
Use by any third party, including architects, builders, stagers, designers, sellers, or buyers, is strictly prohibited without prior written permission from Miami Luxe Images.
This license expires upon the sale of the property, termination of the listing agreement, or transfer of the listing to another agent or brokerage.
Any future use by a new listing agent or for a new listing of the same property requires a new license, which may be purchased at the discretion of Miami Luxe Images.
Media is licensed for use on MLS, social media, email marketing, and printed marketing materials. Use for short-term rentals is only permitted if covered under a separate short-term rental service.
Commercial use or resale requires additional licensing.
Media may not be resold, altered, or reused for another property or listing.
Clients agree to ensure the property is accessible, clean, and photo-ready at the scheduled time. Any special requests or required shots must be communicated in advance.
Accurate access details and contact information must be provided.
Miami Luxe Images is not responsible for delays or incomplete shoots caused by lack of access or unprepared properties.
Content is delivered via Aryeo or another agreed-upon platform.
Estimated turnaround times are provided at booking.
Rush delivery may be available for an additional fee.
Once media is delivered, the client is responsible for downloading and storing all files.
Due to the nature of digital services, all sales are final once content has been delivered.
If concerns arise, reasonable efforts will be made to address issues or provide minor revisions when appropriate.
Miami Luxe Images is not liable for lost income, listing delays, technical issues beyond our control, incorrect access information, or acts of nature. Liability is limited to the amount paid for the specific service provided.
We utilize third-party services including Aryeo (client portal), Stripe (payments), Dropbox or Google Drive (file delivery), and tools for floor plans and analytics.
These services operate under their own terms and privacy policies.
Our content may also be embedded or shared across platforms such as YouTube, Instagram, Facebook, LinkedIn, and Google.
Interaction with content on those platforms is subject to their respective policies.
Miami Luxe Images may update these Terms of Service at any time.
The most current version will always be posted on our website.
